Government of Canada Tobacco and Vaping Products Act   

  • Nicotine Concentration Cap (20 mg/mL): Under federal regulation, the absolute maximum allowable nicotine concentration in any vaping product sold in Canada is 20 mg/mL. This law successfully eliminated high-potency "super-juices" (which historically reached 59 mg/mL) from the market. 

  • The Federal Flavour Ban Status: While Health Canada initially proposed a sweeping national ban on all youth-appealing dessert and fruit flavors across all retail channels, a national ban has faced extensive federal delays. Public health groups continue to lobby Ottawa to finalize a uniform, nationwide flavor restriction. 

 

 

Government of Saskatchewan Tobacco and Vapour Products Control Act    

The primary law governing e-cigarettes in the province is the Tobacco and Vapour Products Control Act. Under current regulations, the main provisions include: 

  • Effective February 1, 2024, the minimum legal age to purchase tobacco and vaping products in Saskatchewan was officially raised from 18 to 19 years old. This critical policy amendment aims to prevent legal-age high school students from acting as "social sources" or straw buyers for underage peers. Retailers must verify age using government-issued photo ID. 

  • Flavor Restrictions & Retail Gating: The sale of flavored e-liquids excluding tobacco, mint, and menthol is strictly restricted to adult-only specialty vape shops where minors are legally barred from entry. Convenience stores, gas stations, and general retailers are completely prohibited from stocking fruit, candy, or dessert profiles. 

  • Public Use and Banning Mandates: It is completely illegal to use a vapour product in enclosed public buildings, workplaces, or within 3 meters of building entrances, windows, and air intakes. Furthermore, vaping is strictly banned across all school grounds and inside vehicles carrying passengers under the age of 16. 

  • Advertising Restrictions: Retailing environments accessible to youth are under strict display bans. General promotion, point-of-sale displays, or lifestyle advertisements that could visually target or appeal to minors are prohibited.

Flavor Ban & Retail Restrictions: Legislation officially bans the sale of fruit and dessert flavors in any retail environment where minors can enter.

20% Vapour Products Tax (VPT): Saskatchewan implements a dedicated 20% provincial consumption tax specifically on all vaping hardware and e-liquids, replacing the standard 6% PST. This results in a combined 31% tax rate (GST + PST + VPT) at retail checkouts. 

February 2020 

Bill 182 Proclaimed: The original Tobacco Control Amendment Act officially takes effect, renaming the legislation to the Tobacco and Vapour Products Control Act and introducing structural display bans.
